The temporary residence permit (ART) is a title of residence that allows foreigner citizens to live in Portugal during a limited period of time.
- In rule is valid for a period of a year after de issue date of the respective title; ,
- It is renewable for successive periods of two years;
- The residence title must always be renewed whenever changes to the identification elements herewith occur.
To grant a temporary residence permit, the applicant must meet the following special conditions besides those special conditions according to the purpose:
- Holds a valid visa of residence;
- Presence in the Portuguese territory;
- Inexistence of any fact that, if know by the authorities before granting the visa, would stop its concession;
- Means of subsistence;
- House;
- Registration in the social security;
- Absence of a condemnation for a crime that in Portugal is punishable with a deprive freedom penalty of a length higher than one year;
- It is not within the period of interdiction, subsequent to a measure of retirement;
- It is not indicated in the Information System Schengen;
- Cannot be indicated in the Integrated System of Information of SEF for effects of non-admission;
- The residence permit can be refused for reasons of public order, public security or public health.
The request of residence permit may be submitted by the applicant or his legal representative, and may be extended to minors depending from the applicant.
As a rule, the request must be submitted to SEF in the area of residence of the applicant.
While is pending the request of residence permit, for a cause that is not imputable to the applicant, the holder of the visa of residence is not forbidden from performing a professional activities, in accordance to the law, regarding the type of residence permit in question.
